Greetly, Inc. (“Greetly”, “we”, “our” or “us”) is committed to protecting and maintaining your privacy. This Privacy Policy explains what information we may collect when you use the web or mobile site www.Greetly.com (the “Website”), our iOS or Android apps,

and/or any related end clients, tools, applications, data, software, Application Program Interfaces (APIs), or other services (collectively, the “Service” or “Services”)  related thereto, how it will be used, and how you can control the collection and use thereof.

Greetly also recognizes that the European Economic Area (EEA) and United Kingdom (UK) have established strict protections regarding the handling of personal data, including requirements to provide adequate protection for such personal data transferred outside of the EEA and the UK.  To provide adequate protection for personal data received by Greetly in the U.S. from the EEA and the UK, Greetly adheres to the Privacy Shield principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity, and Purpose Limitation, Access, and Recourse, Enforcement, and Liability.

Please read the following carefully to understand our practices regarding your personal and business data. By registering as a user or using our Website or Services or otherwise submitting any information to us, you consent to the collection and use of personal information as explained in, and agree to abide by the terms of, this Privacy Policy.

Information That May Be Collected by Us

Information that you give us. You may provide us with information about yourself when you register with or use Greetly’s Services.

This may include your‎ name, postal address, email address, phone number(s), username, password, photographs that you upload, your account information related to web tools (e.g. automation tools, messaging apps) that you utilize, time zone, demographic information, information related to your occupation (e.g. company, title, office location), and information related to visitors to your offices (e.g. name of visitor and arrival and departure times). If you correspond with us via email, chat, Website form submission, in writing, or by telephone, we may retain the content of those communications and our responses, as well as your email address, mailing address, and/or telephone number. In addition, you may provide information about yourself by filling out forms or by completing surveys created by us.

Information may be automatically collected. We (directly or through our third-party service providers) may automatically log information about you and your computer. Log file information is automatically reported by your browser each time you access our Services. When you register with, view, or use our Services, our servers automatically record certain information. These server logs may include information such as your web request, IP address, operating system type, browser type, browser language, referring / exit pages and URLs, the number of clicks, domain names, landing pages, pages viewed, how long you spent on a page, access times, and other similar types of information.

Information we get from others. We may get information about you from third parties and/or from other sources, for example by collecting data that is publicly available (e.g. information you submit in a public form). 

Cookies. We may log information about your general internet usage using "cookies." Cookies are small data files stored on the hard drive of your computer. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them). Cookies contain information that is transferred to your computer’s hard drive. They help us to improve the Services, to provide a more personal and interactive user experience by enabling us to estimate our audience size and usage pattern, to store information about your preferences and customize our Services accordingly, and to recognize you when you return to our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system may issue cookies when you log on to the Website. You can set your web browser to refuse all cookies or to notify you when a cookie is being sent. However, some features of the Website may not function properly if cookies are disabled.

Clear gifs information. When you use the Website, we may employ clear gifs which are used to track the online usage patterns of our users anonymously. No personally identifiable information is collected using these clear gifs. In addition, we may also use clear gifs in emails sent to our users to track which emails are opened by recipients.

Information on minors. We do not intend to solicit or collect any personally identifiable information from children under the age of 13 years old. If we learn that a child under the age of 13 has provided personally identifiable information to us, we will promptly remove such information from our file. If you believe that a child under the age of 13 has disclosed personally identifiable information to Greetly, please report this to us immediately by emailing us at success@greetly.com. We do not require a child under the age of 18 to disclose more information than is reasonably necessary to participate in an activity as a condition of participation. If a child under the age of 18 has provided personally identifiable information, a parent can review the child’s personal information, ask to have it deleted, and refuse to allow any further collection or use of the child’s information by emailing us at success@greetly.com. Parental consent is required for the collection, use, and disclosure of the information collected from children under the age of 18. A parent can provide consent or revoke it at any time by contacting us in accordance with the methods identified below under the heading “Contact Us”. Parents have the option to agree to the collection and use of the child’s information without consenting to the disclosure of the information to third parties.

By providing your email address to us, you consent to our using such email address to send you notices related to our Services, including, without limitation, any notices required by law, in lieu of communication by postal mail. Some of these communications may not be opted out of. We may also use your email address to send you other messages, including, without limitation, changes to the Services. You may modify your settings with respect to these emails by changing your email preferences.  We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to subsequently re-enter it when using our Services; (b) provide custom, personalized content, and information; (c) monitor the effectiveness of the Services that we provide; (d) monitor aggregate metrics such as total usage; (e) diagnose or fix technology problems; (f) monitor and prevent fraud; and (g) help you efficiently access your information after you sign in.

How We Use Your Information

  • We use your personal information to operate, maintain and improve our sites, products, and services. In particular, this includes sending push notifications to personnel within your organization.
  • We use your personal information to respond to comments and questions and provide customer service.
  • We use your personal information to send information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.
  • We use your personal information to communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners.

Under certain circumstances, we may remain liable for the acts of our third-party agents or service providers who perform services on our behalf for their handling of personal information that we transfer to them.

Customer, email, and user information is generally transferred in these types of transactions, and you hereby consent to any such transfer. In any such transfer of information, your user information would remain subject to this Privacy Policy, and any reference to “Greetly”, “we”, “our” or “us” in this Privacy Policy would mean the successor to us or our business, although any successor may alter the terms of this Privacy Policy.

For example, we may disclose identifiable personal information to third parties when required to do so by law or subpoena or if we believe that such action is necessary (a) to conform to applicable law, to comply with legal process served on us or our affiliates (including, without limitation, any investigation by a regulatory agency or other valid requests by public authorities, including to meet national security or law enforcement requirements), or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to investigate and monitor compliance with, and to protect or enforce our rights, including under the Terms of Service or our other agreements and policies, to take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; or (c) to exercise or protect the rights, property, or personal safety of us, our employees and agents, our users and customers, or others, including without limitation, to credit reporting or collection agencies in connection with efforts to collect any amounts owed by you to us. Non-personally identifiable information. We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages, and Uniform Resource Locators (URLs), platform types, number of clicks, etc.) with third parties who wish to understand the usage patterns of our Services.

  • We may disclose certain information about you and/or your use of our Services to third parties without identifying your personally identifiable information for any lawful purpose, including, but not limited to, analyzing how our Services are used, diagnosing technical problems, maintaining security, and personalizing advertisements and promotions. We may de-identify personally identifiable information and share it in a de-identified or aggregated form with third parties, advertisers, and/or business partners for any lawful purpose.
  • We may allow third-party advertising servers to place advertisements within our Services. These third-party advertising servers or advertising networks use technology to send, directly to your browser or device, the advertisements, and links that appear within the Services. They automatically receive your IP address when this happens. They may also use other technologies to measure the effectiveness of their advertisements and to personalize the advertising content. We may provide such third parties with aggregate information about our users (for example, we may inform them that a certain number of women of a given demographic have clicked on their advertisement over a given time period). We may also use such aggregate information to help advertisers reach their target audience. We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisements to that target audience. The Greetly Privacy Policy does not apply to, and we cannot control the activities of, such advertisers. In addition, we may make products and services of third parties available through the Website or within our Services. The Greetly Privacy Policy does not apply to any websites operated by, and we cannot control the activities of, such third parties.

How We Protect Your Information

We use commercially reasonable safeguards to preserve the integrity and security of your personal information. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. We will use commercially reasonable efforts to restrict employee access to personally identifiable user information to those who need to know it in order to provide the Services to you. We cannot, however, ensure, warrant or guarantee the security of any information that you transmit to us, and you do so at your own risk. We make no guarantee that such information will not be accessed, disclosed, altered, or destroyed notwithstanding our safeguards.

To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You hereby agree to accept responsibility for all activities that occur under your account or password.

Compromise of Personal Information

In the event that your personal information is compromised as a result of a breach of security, we will promptly notify you in accordance with the notification procedures set forth in this Privacy Policy, and as otherwise required by applicable law.

Your Access to and Choices About Your Information

You may decline to submit certain information to us, in which case we may not be able to provide certain Services to you. You may update your account information and email preferences at any time by signing into your account. You are solely responsible for helping us to maintain the accuracy and completeness of your personal and other information. You may opt-out of any future contact from us at any time. You can do the following at any time by emailing us at success@greetly.com.  You can also choose to opt-out of our sharing of your personal information with third parties, except where the disclosure has already been made to a third party in accordance with this Policy or where the disclosure is made to a third party that is acting as a service provider for Greetly.  We will also not use or disclose your personal information for a purpose that is materially different than the purpose it was collected for without notifying you and requesting your consent.  If you choose not to consent to such use or disclosure, you may choose to decline or opt-out of it at that time.   

Please note that any opt-out requests may take a reasonable period of time for us to process.

As noted above, you can access and change your personal information in your account.  You may also have the right to access the personal information that we hold about you and to request that we correct, amend, or anonymize it if it is inaccurate. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access.  If you would like to request access to, correction, amendment, or deletion of your Personal Data, you can submit a written request to the contact information provided above. We may request specific information from you to confirm your identity. In some circumstances, we may charge a reasonable fee for access to your information.

Links to Other Websites

We may make products and services of third parties available through the Website or within our Services. This may include links to websites or services operated by such third parties. We are not responsible for the practices employed by third-party websites linked to or from our Services nor the information or content contained therein. When you use a link to go from our Services to a third-party website, our Privacy Policy is no longer in effect. Your browsing and interaction on any third-party website, including, without limitation, those that have a link on our Website or Services, is subject to that website’s own rules and policies. Please check the policies and the terms of such websites before you submit any personal data to such websites. We do not control how these third parties collect information or by what means such third-party services or third parties may use their own cookies to collect information about you. We do not endorse, screen, or approve, and are not responsible for the privacy practices or the content of, other websites or services. Greetly EU Bot use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Notification Procedures

It is our policy to provide any notifications to you, whether such notifications are required by law or are for marketing or other business-related purposes, via email notice, written or hard copy notice, or through conspicuous posting of such notice on our Website or other Services, as determined by us in our sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may on our Website opt-out of certain means of notification as described in this Privacy Policy.

Changes to Our Privacy Policy

We may revise this Privacy Policy at any time by amending this page (and noting the date of the update). You are expected to check this page periodically to take notice of any changes made. Your continued use of our Services after such posting constitutes your consent to the collection and use of your information as described in the then-current Privacy Policy. Any such changes will be binding on you, and if you disagree with any such changes, you should discontinue the use of the Services.

This Privacy Policy is subject to our Terms of Service and any other agreements between you and Greetly. Please refer to the Terms of Service or such other agreements regarding certain rights and limitations with respect to your use of our Website or Services.

Applicable Law and Jurisdiction; Dispute Resolution

Our service is maintained in the United States of America. We make no representation that the Website or our Services are operated in accordance with the laws or regulations of any other country. If you are located outside of the United States and the European Union, you use the Website and our Services at your own risk and initiative and you, not us, are responsible for compliance with any applicable local and national laws, which may differ from U.S. law, and by using our Services, you authorize and consent to the export and transfer of personal information to the U.S. and its storage and use as specified in this Privacy Policy.

This Privacy Policy shall be governed by, construed, and entered in accordance with the laws of the State of Delaware applicable to contracts deemed to be made within such state, without regard to choice of law or conflict of law provisions thereof. All disputes with respect to this Privacy Policy shall be brought and heard either in the state courts located in New York County, NY, or the federal district court for New York County, NY (and any courts from which appeals from such courts may be heard). You consent to the in-person jurisdiction and venue of such courts. YOU HEREBY WAIVE YOUR RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY CLAIM, ACTION OR PROCEEDING, DIRECTLY OR INDIRECTLY, ARISING OUT OF, OR RELATING TO, THIS PRIVACY POLICY TO THE FULLEST EXTENT PERMITTED BY LAW.
